Pangan merupakan kebutuhan dasar yang paling dibutuhkan setiap hari oleh manusia. Peredaran produk makanan dan minuman yang mudah ditemukan di pasaran, sangat memungkinkan beredarnya pangan yang tidak memenuhi standar kesehatan yang seharusnya memperhatikan keamanan, mutu, maupun gizi. Produk pangan yang beredar menjadi tanggung jawab orang yang memproduksi dan yang mengedarkan, terutama jika pada penggunaan atau konsumsinya terjadi kerugian kesehatan maupun kematian seseorang yang mengonsumsi produk tersebut. Tujuan pengawasan pada produk pangan sebelum diedarkan adalah untuk menjamin keamanan, manfaat, serta mutu pada produk sebelum produk tersebut dikonsumsi. Terhadap sistem sampling dan uji laboratorium masih terdapat beberapa kelemahan yaitu dengan jumlah produksi yang banyak tidak memungkinkan untuk mengawasi semua produk-produk pangan dan pelaku usahanya. Undang-Undang Perlindungan Konsumen diperkuat dengan berlakunya Undang-Undang Nomor 18 tahun 2012 tentang Pangan, Peraturan Pemerintah tentang keamanan pangan, label serta iklan pangan, maupun Peraturan Pemerintah tentang mutu, gizi serta ketahanan pangan menjadi langkah pemerintah untuk memberikan perlindungan kepada produsen dan terutama kepada konsumen terkait keamanan serta mutu pangan. Perlindungan hukum preventif merupakan perlindungan hukum yang sudah diberikan sebelum terjadinya sengketa sementara perlindungan hukum represif yang bertujuan untuk menyelesaikan suatu permasalahan atau pelanggaran saat sudah terjadinya sengketa.

Food is the most basi necessity needed by humans every day. The distribution of food and beverage products that are easily found on the market makes it very possible for the circulation of food that does not meet health standards that should pay attention to safety, quality, and nutrition. Food products in circulation are the responsibility of the people who produce and distribute them, especially if the use or consumption results in health loss or death of a person consuming the product. The purpose of monitoring food products before distribution is to ensure the safety, benefits, and quality of the product before the product is consumed. There are several weaknesses in the sampling and laboratory test system, namely the large amount of production it is not possible to supervise all food products and business actors. The Consumer Protection Law is strengthened by the enactment of Law Number 18 of 2012 concerning Food, Government Regulations on food safety, food labels and advertisements, as well as Government Regulations concerning quality, nutrition and food security, which are government steps to provide protection to producers and especially to consumers related to food safety and quality. Preventive legal protection is legal protection that has been given before the occurrence of a dispute while repressive legal protection which aims to resolve a problem or violation when a dispute has occurred.
