ASPEK HUKUM KERAHASIAAN PERBANKAN DALAM IMPLEMENTASI BERBAGAI INFORMASI DATA KEUANGAN NASABAH PIHAK KETIGA DAN DEBITUR

Banking financial industry service is a service needed by various groups of society both in terms of collecting third party funds in the form of savings, deposits and current accounts or in terms of channeling funds or also called credit. These various banking services are certainly not allowed to be known by the public because they are related to the confidentiality of financial data conducted by customers to the banking industry. The secrecy aspect of banking services to its customers is an aspect that must be upheld by the banking industry, but for implementation to run optimally, of course there must be sanctions that can create a deterrent effect if it is not obeyed by parties who are sanctioned by a legal rule. In RI Law no. 10 of 1998 concerning Banking has been regulated regarding the confidentiality aspects of customer data relating to the collection of third party funds, along with the sanctions if the existing ones release information without the permission of the authorities or the bank itself based on instructions or instructions from the authorities. The rules of confidentiality of customer data relating to the field of credit are not regulated in RI Law no. 10 of 1998. This often creates new problems for customers or debtors when in the field there are various types of credit offers from various financial institutions as a result of unprotected debtor customer data well in the banking industry, even though the Financial Industry Service System (SLIK) has been implemented with both in the Banking industry.

Aspek kerahasiaan layanan perbankan terhadap nasabah-nasabahnya merupakan sebuah aspek yang harus dijunjung tinggi oleh industri Perbankan , namun untuk implementasi bisa berjalan maksimal, tentunya harus ada sangsi yang dapat membuat efek jera apabila tidak ditaati oleh pihak yang diberikan sangsi oleh sebuah aturan hukum. Di dalam UU RI no. 10 tahun 1998 tentang Perbankan telah diatur mengenai aspek kerahasiaan data nasabah yang berkaitan dengan penghimpunan dana pihak ketiga, berikut dengan sangsi � sangsinya apabila yang ada mengeluarkan informasi tanpa seijin pihak berwenang ataupun pihak bank itu sendiri berdasarkan instruksi atau petunjuk dari pihak yang berwenang. Aturan kerahasiaan data nasabah yang berhubungan dengan bidang perkreditan tidak diatur di dalam UU RI no. 10 tahun 1998. Hal ini seringkali menjadikan masalah baru bagi nasabah atau debitur ketika di lapangan terdapat berbagai macam penawaran kredit dari bermacam lembaga keuangan sebagai akibat tidak terlindunginya data nasabah debitur dengan baik di industri perbankan, meskipun Sistem Layanan Industri Keuangan ( SLIK ) sudah diimplementaikan dengan baik di industri Perbankan.
