TINJAUAN YURIDIS PENGARUH PENGAKUAN SEPIHAK CHINA ATAS ZONA EKONOMI EKSKLUSIF LAUT NATUNA UTARA BERDASARKAN HUKUM INTERNASIONAL

China melakukan klaim sepihak dengan menggambarkan sembilan garis putus-putus yang didasarkan atas sejarah historisnya yang mengakui wilayah perairan Zona Ekonomi Eksklusif Natuna sebagai bagian dari kedaulatannya yang dapat berpotensi terjadinya persengketaan batas maritim. Metode penelitian penulisan ini menggunakan penelitian normatif yuridis dengan rumusan masalah sebagai berikut: 1. Bagaimanakah pengaruh pengakuan sepihak China pada kedaulatan Indonesia di wilayah perairan Zona Ekonomi Eksklusif Natuna berdasarkan hukum internasional: 2. Bagaimanakah pengaruh terhadap ruang udara akibat dari pengakuan sepihak China di wilayah Laut Natuna Utara. Dengan rumusan masalah di atas dapat diambil kesimpulannya yaitu; 1. Delimitasi maritim Indonesia dengan garis sembilan putus-putus yang digambarkan oleh China dan dimasukkan kedalam peta wilayah Laut Natuna Utara dapat mengancam kedaulatan dan hak berdaulat yang dimiliki oleh Indonesia; dan 2. Kebebasan penerbangan (Freedom of Overflight) dalam Zona Ekonomi Eksklusif diatur di dalam Pasal 58 UNCLOS 1982. Selain itu, Indonesia dapat melakukan upaya untuk meminimalisir terjadinya pelanggaran di ruang udara dengan membentuk ADIZ.

China makes a unilateral claim by describing the Nine dashed lines based on its historical history of recognizing the territorial waters of the Natuna Exclusive Economic Zone as part of its sovereignty that could potentially cause maritime boundary disputes. This method of writing research uses juridical normative research that obtain the following problem: 1. How does China s unilateral recognition of Indonesia�s sovereignty affect Indonesia�s territorial waters of the Natuna Exclusive Economic Zone based on international law; 2. How does the impact on air space result from China s unilateral recognition of the North Natuna Sea region. With the problems above can be concluded that is; 1. Indonesia s maritime delimitation with the dashed Nine lines depicted by China and included in the map of the North Natuna Sea region may threaten the sovereignty and sovereign rights held by Indonesia; and 2. Freedom of Overflight in the Exclusive Economic Zone is stipulated in Article 58 of UNCLOS 1982. However, if a foreign aircraft crosses over a country s territorial sea then there must be an agreement both bilaterally and multilaterally to obtain permission to cross the territory. However, the freedom of flight in the Exclusive Economic Zone does not mean that it is not under supervision and regulation in this case the supervision of Indonesia on the freedom of this flight. In addition, Indonesia can make efforts to minimize violations in the airspace by forming ADIZ.
