Human Rights are rights inherent in humans are not given by society or by positive law because it is solely because he is a human. However, today it is inevitable that violations against human rights still occur frequently. Violations of the freedom of rights held by the existence of restraints on one s basic rights, discrimination against an ethnic group to the extermination of a certain group still occur in the midst of the international community that upholds the equality and dignity of human life. Violations of regulations and serious crimes against human rights require special regulations because they relate to human life that should be free from insecurity and restraint. Ethnic Uighur Muslims are indigenous or indigeneous in the People s Republic of China. They are immigrants from Turkey who have settled in East Turkistan since the Karakatai Dynasty. Ethnic Uighur Muslims who are ethnic minorities in the People s Republic of China (RRT) located in northwestern China are bordered by Kazakhstan, Kyrgyzstan, Tajikistan, Pakistan and Afghanistan. The region is known as East Turkistan. While China calls it by the name of Xinjiang, which means a new block. In the region a massacre took place by Chinese authorities against Uighur Muslims. Uighurs are closer in language to ethnic Turk (who speak Turkic), if culturally with neighboring countries such as Tajikistan, Kazakistan and Kyrgyzstan, and religiously constitute the majority of Muslims. The Uighurs have long maintained their independence, but due to the Chinese government s policy which discriminates against the Uighurs with the Sinicization policy, the Han (native Chinese tribe) control East Turkistan now called Xinjiang (new bloc) with occupation, occupation, forced coercion of communist ideology, forcing to renounce previous beliefs, concentration camps or re-education camps or re-education camps as Uighur ethnic prisoners under the pretext of eradicating extremism and terrorism which are alleged to be ethnic Uighur Muslims. But until now it has not been proven what was simmered by the Chinese government. The research method uses a normative juridical approach with a descriptive analysis type of research based on theories of human rights, principles of human rights, the Rome Statute or the International Criminal Court, theories of humanitarian crime and their elements, jurisdiction theory, state theory and state form, the role of the United Nations and the role of the International Criminal of Court (ICC). The elements of crimes against humanity have been fulfilled and the role of the UN Security Council and the ICC has jurisdiction in handling these humanitarian crimes. As additional data, the author adds that there are interviews with non-governmental parties that focus on the field of handling human rights, namely Human Rights Watch and Human Rights Watch Indonesia.
