PERLINDUNGAN HUKUM TERHADAP PENGUNGSI WARGA NEGARA ASING BERDASARKAN PERATURAN PRESIDEN NOMOR 125 TAHUN 2016 TENTANG PENANGANAN PENGUNGSI DARI LUAR NEGERI DAN KONVENSI 1951 TENTANG STATUS PENGUNGSI

Indonesia has not ratified the 1951 Convention and 1967 Protocol on the Status of Refugees. But even though it has not yet ratified Indonesia has a legal basis namely Presidential Regulation Number 125 of 2016 concerning Handling of Refugees from Overseas. With this Presidential Regulation based on considerations to implement the provisions of Article 27 paragraph (2) of Law Number 37 of 1999 concerning Foreign Relations. The problem in this study regarding refugees in Indonesia is how the legal protection of refugees of foreign nationals based on Presidential Regulation of the Republic of Indonesia Number 125 of 2016 concerning Handling of Refugees from Overseas Affairs and the 1951 Convention on the Status of Refugees and how the legal consequences of refugees of existing Foreign Citizens in Indonesia as a country that did not ratify the 1951 Convention on the Status of Refugees. The research method used is normative legal research obtained from secondary data on legislation and qualitative data analysis methods by taking data from books and other literature sources. The results of this study note that Indonesia already has a legal umbrella to deal with refugees with the Presidential Regulation of the Republic of Indonesia Number 125 of 2016 concerning Handling of Refugees from Foreign Affairs and Indonesia has not ratified the 1951 Convention on Refugee Status. the description above if related to the theory of monism Indonesia can provide access to education and employment because Indonesia has ratified the International Covenant on Economic, Social and Cultural Rights because international law is higher in the hierarchy than national law when using the theory of monism. And it is different if Indonesia uses the theory of dualism even though Indonesia has ratified the International Covenant on Economic, Social and Cultural Rights, which addresses education and employment. In the theory of dualism there is no place for hierarchical issues between national law and international law
