PERLINDUNGAN TERHADAP HAK KONSUMEN TERKAIT PENARIKAN PAKSA KENDARAAN BERMOTOR AKIBAT KREDIT MACET (ANALISA PUTUSAN MAHKAMAH AGUNG NOMOR 571 K/PDT.SUS-BPSK/2017)

In several regions of Indonesia there are still often cases of forced withdrawal of a consumer of a motor vehicle purchased on credit through an agreement and the motorized vehicle has been charged with fiduciary security. Forced withdrawal of motorized vehicles by business actors, but what happened was that business actors used the services of a debt collectot. The procedures performed at the time of withdrawal or execution of fiduciary collateral items are not in accordance with the regulations in force in Indonesia. Therefore, this paper aims to determine the rights of consumers related to forced withdrawals and determine the impact on business actors for acts of execution that deviate from the legislation. This research uses normative juridical type of research method which is qualitative in nature. The result of this writing is that the rights of consumers as regulated in Article 4 of the Consumer Protection Act have been violated by business actors, as well as violating the procedure for executing objects that are subject to fiduciary security as regulated in Article 29 of the Fiduciary Guarantee Act. The impact that will be received on business actors in the form of warning sanctions, freezing of business activities and revocation of business licenses. The sanctions were given by the Minister of Finance based on Minister of Finance Regulation Number 130 / PMK.010 / 2012 and Minister of Finance Regulation Number 84 / PMK.012 / 2006.
