PERAN PENGADILAN PERIKANAN DALAM ILLEGAL FISHING OLEH KAPAL ASING DI WILAYAH KEDAULATAN LAUT INDONESIA

According to Indonesian Law No. 31 Year 2004 Regarding Fisheries, illegal fishing is a theft made by catching fish without SIUP and SIPI, using explosives, toxic materials, hazardous materials and others causing the destruction and extinction of fish resources. The fishery court is a special court created in the general court�s scope, based on Indonesian Law No. 31 Year 2004, specifically to check, to adjudicate and to judging a cases of fishery crime or illegal fishing. Due to its specificity, there are some differences in the trial process in the district courts and fishery courts, one of which is the composition of judges, the conduct of trials with or without accused attend the trial, and the appropriation of evidence for the state. In addition to the establishment of a fishery court, the sinking of vessels is another way of enforcing fisheries laws to be more cost effective and lightweight, and a deterrent effect. According to Indonesian Law No. 45 Year 2009, fishery investigators and / or supervisors can sink foreign ships without a court decision first, but based on sufficient initial evidence.
