PENERAPAN RESTORATIVE JUSTICE DALAM TINDAK PIDANA PENCUCIAN UANG YANG BERASAL DARI TINDAK PIDANA PENIPUAN

In the Decision of the South Jakarta District Court Number: 440 / Pid.B / 2015 / PN.JKT.SEL., The Panel of Judges has sentenced verdicts to Defendants I and Defendant II based on fraud 377 of the Criminal Code and money laundering as stated in Article 2 paragraph (1) letter r Juncto Article 3 of Law Number 8 of 2010 concerning Eradication and Prevention of Money Laundering (TPPU). In the judge s consideration, in the case of Defendant I, the Panel of Judges applied the principle of restorative justice, because Defendant I returned part of the proceeds of crime to the victim. So Defendant I was sentenced to a lighter sentence namely imprisonment for 10 (ten) months, while Defendant II was sentenced to 2 years 2 months. However, based on the chronology and proof of the trial, Defendant I was the mastermind behind the crime and the party that received the greatest benefit. On these two grounds, at the Supreme Court level, the judges of the Supreme Court handed down a higher punishment to Defendant I
