PENJATUHAN SANKSI PIDANA YANG SAMA ANTARA PERMUFAKATAN JAHAT DENGAN DELIK PERCOBAAN DALAM TINDAK PIDANA KORUPSI

An wicked consensus occurs when a crime has been committed (over-taken) by two or more people. The problem in this study is what is the basis for the law to impose criminal sanctions against wicked agreements in criminal acts of corruption? and whether it is appropriate to equate the wicked agreement in a criminal act of corruption with a criminal act of probation so that the same crime is imposed in the Decision of the Supreme Court Number 2547 K / Pid.Sus / 2011 dated March 7, 2012? The research method used is normative juridical using secondary data. The results of the study showed that the legal basis for criminal sanctions against wicked consensus in corruption is the philosophy of establishing the Corruption Eradication Act, Constitutional Court Decision Number 21 / PUU-XIV / 2016 and Article 15 of the Corruption Eradication Act. Because corruption is an extraordinary crime, then the effort to eradicate corruption should also be done with extraordinary efforts. However, in relation to wicked agreements, it can only be applied to agreements between two or more people having special qualities as civil servants or state officials as referred to in Article 1 number 1 and Article 1 number 2 of the Law on the Eradication of Corruption.
