PENERAPAN SANKSI PEGAWAI PENCATAT PERKAWINAN TERHADAP PERKAWINAN SAH YANG TIDAK DICATATKAN

The purpose of this research is to know the legal consequences for the parties if administrative requirements are not fulfilled in filing for divorce in the absence of a Marriage Certificate and to know the application of sanctions for Marriage Registrar for not registering a legal marriage. The research method used is normative legal research with the results of the study: 1) Legal consequences if administrative requirements are not met in filing for divorce is that the application for divorce cannot be fulfilled because the applicant cannot prove that his marriage is valid with evidence in the form of a Marriage Certificate Quotation, which is a mandatory requirement as determined by the regulations made by the Religious Court and 2) Application of sanctions for Marriage Registrar who neglects their duties because they do not register legal marriages is very rarely implemented or even not applied because such cases are very rare. Most Marriage Registrar is aware and responsible for their duty to register a marriage.
