ANALISIS HUKUM PERAN PEMBANTU DALAM TINDAK PIDANA PERDAGANGAN ORANG TERHADAP TERDAKWA YANG MERUPAKAN ANGGOTA POLRI

The purpose of this research is to know the application of criminal law on the crime of human trafficking carried out by members of the Police verdict of Persons number: 22/Pid. Sus/2015/PN. Atb. And to know the legal reasoning by the judge on the criminal offence of human trafficking carried out by members of the POLICE verdict of Persons number: 2470/K/pid. SUS/2015 this research was conducted in Jakarta, namely the Court of Atambua and Kupang district. By studying the data obtained from the results of the library that is the verdict of the number: 2470-K/Pid. Sus/2015, books, documents, and legislation related to the issues discussed. The results obtained from the study as follows: the norm of Soldiering in the Ruling number: 2470-K/Pid. Sus/2015 Court Negri Kupang is it right because of the indictments in the criminal verdict 3 months in jail as well as whether there are elements applicable in law forgiving in the regulations the public prosecutor, was chosen by the judge who declared that the defendant is proven guilty of criminal acts of Trafficking people are organized and threatened criminal in chapters 2 and 4 Jo 10 UURI No. 21 of the year 2007 the regulation of criminal law for the entire territory of Indonesia, as well as additional criminal i.e. Crime Office, This ruling strengthened by the Court ruling, according to Negri authors have no suitability because all the elements in the alternative claims have been met since the first alternative claim has been proven with evidence, witnesses, and description of the defendant so the judge obtaining the conviction that the defendant had committed the crime of people trafficking which is set out in article 2 and 4 Jo 10 RI ACT No 21 of the year 2007.
