ANALISIS HUKUM PENOLAKAN PENCAIRAN BANK GARANSI OLEH BANK SYARIAH BUKOPIN CABANG KELAPA GADING (STUDI KASUS PT BERKAH KAWASAN MANYAR SEJAHTERA SEBAGAI PENERIMA BANK GARANSI DENGAN PT BERKAH TIGA USAHA SEBAGAI TERJAMIN)

One of the banking institutions services in supporting business activities is a bank guarantee. Bank Guarantee can assist business actors in financing a work project. This research to examine a legal conflict that occurs when a Bank Guarantee that is proposed for disbursement by the Bank Guarantee Holder is rejected by the bank that issued the Bank Guarantee. The issuance of a bank guarantee is always preceded by a Cooperation Agreement between the guaranteed party / party guaranteed by a Bank (Applicant) and the recipient or holder of the Bank Guarantee (Beneficiary) issued by the guarantor Bank. The research problems are What are the legal remedies against the refusal of bank guarantee disbursement by the recipient of the bank guarantee if the guaranteed party has defaulted? And How banks apply the bank prudential principle as an excuse to refuse bank guarantee disbursement? The results of this study indicate that the legal action that must be taken by the recipient of the bank guarantee against the refusal of disbursement by the issuing bank is to continue to take legal procedures for disbursing the Bank Guarantee as stipulated in the bank guarantee statement. by continuing to prioritize the use of the banking mediation process, and the last resort a lawsuit in court. And if the bank is going to refuse the disbursement, it should be done with a strong legal basis and applicable in general banking practice.
